The United States government grants Asylum to immigrants on a discretionary basis if it is determined that an applicant has suffered past persecution in their home country and has a “well-founded fear of persecution.” The asylum application is complex process that involves proving a strong, compelling case for asylum. The process involves appearing before an Immigration Officer authorized to investigate asylum applications, and in the case of rejected application, an appeals process to an immigration court could be involved.
Applying for asylum is not a guarantee that you will be allowed to stay in the United States. Each and every case for asylum is decided individually. Once an individual has been granted asylum, then that person can apply for permanent residency.
